Legal Basis

Which obligation does it fulfil?

Sending commercial electronic messages is subject to the prior approval and IYS registration obligation. IYS CEREZGO™ fulfils this obligation in its entirety.

Framework: Law No. 6563 on the Regulation of Electronic Commerce and the Regulation on Commercial Communication and Commercial Electronic Messages. As personal data is processed for marketing purposes, the provisions of Law No. 6698 (KVKK) are also taken into account.

How is IYS integration done?

What is the IYS API and how does it work?

Are explicit consent and IYS approval the same thing?

No. IYS approval is the permission to send commercial electronic messages under Law No. 6563 on the Regulation of Electronic Commerce; explicit consent is the permission to process personal data under Law No. 6698 (KVKK). In marketing activity, both are usually required together. IYS CEREZGO™ manages both consents in a single inventory, together with their evidence.

How is KVKK explicit consent management done with software?

KVKK explicit consent management is recording for what purpose, when and with which text version the consents for personal data processing were obtained, and processing withdrawal requests. IYS CEREZGO™ collects explicit consent with versioned text and time-stamped evidence and associates it with the IYS approval in the same inventory; the burden of proof under Law No. 6698 (KVKK) is thus met in a single system.

Why are IYS registration and approval upload mandatory?

With the amendment made on 4 January 2020 to the Regulation on Commercial Communication and Commercial Electronic Messages (Official Gazette No. 30998), service providers are required to register with IYS. Which messages do not require approval?

Prior approval is not required for messages such as those concerning an ongoing subscription, membership or partnership status, and collection, debt reminder, information update, purchase and delivery notifications. Where the recipient is a merchant or tradesperson, messages may be sent without approval until the right of refusal is exercised. IYS CEREZGO™ separates these exemptions by channel and content.

How is IYS managed for multiple brands or agencies?

Agencies and service providers sending messages on behalf of multiple brands must manage a separate approval inventory and IYS account for each brand. How long does IYS integration take?

The duration becomes clear after the preliminary analysis, depending on the existing system and data structure. In API-based integrations, bringing IYS CEREZGO™ live is usually completed within a few weeks; the scope, channels and systems to be integrated are determined together in the preliminary analysis.

Is there a sanction for not complying with the IYS obligation?

Law No. 6563 prescribes administrative fines for sending commercial electronic messages without permission or with approvals not registered in IYS. Current fine amounts change every year according to the revaluation rate; verification of the current amounts from official sources is recommended. IYS CEREZGO™ helps protect against these sanctions by reducing the risk of non-compliance.
